In a rare Saturday ruling slightly over a week ago, the District Court of Appeals for the 2nd District ruled against Donald Trump, setting up an almost certain appeal by Trump to the US Supreme Court.
Transparency in presidential tax filings are at stake in this 3-year post-Trump-election challenge to Trump's stubborn refusal to follow three decades of presidential protocol by releasing his tax returns.
The 2nd Circuit Court decision affirms the decision and reasoning of the District Court of the Southern District of New York (SDNY).
The State of New York demanded Trump's tax returns in quest of evidence of criminal fraud by Trump. Such might be proven by business and tax accounting that--as suggested under oath by Trump's one-time fixer Michael Cohen--Trump overstated his assets' income production for loan application reasons and understated his assets' income production for tax purposes.
The 2nd Circuit firmly rejected Trump's bald assertion that he cannot even be investigated while in office.
Evidently, POTUS is not above the law.
